| 内容記述 | Fraudulent claims have risks, which might damage insurance system. It is suggested that duty to disclose material facts of moral hazard is one of the methods to repress fraudulent claims. But in Japan, duty to disclose material facts of moral hazard has not been established. In this article, it is submitted that the insured shall disclose material facts of moral hazard under the commercial law, sec. 644, referring to English insurance law. | |||||
