| 内容記述 | 本稿は、親による子の奪取事件に関して英国と日本との対処方法の差異を論じたものである。本稿では、まず国際的レベル、すなわち子の利益の保護を目的とした国際的な子の奪取に関するハーグ条約1980年に関して検討し、次に、国内的レベルとして両国の現実的方針を議論する。日本は英国と異なり本条約は未締結であるため、国際的子の奪取事件へのアプローチの違いにより救済は全く別なものとなっている。日本と英国それぞれの法的解決システムの比較は難しいが、本稿は、子の奪取事件の当事者が最大限の利益を得るために、両国の法的解決が十分であるかどうかの検証を目的とする。 | |||||
