| 内容記述 | 本稿は、外国仲裁判断の承認及び執行における拒否事由を検討し、そこからミャンマーなどの発展途上国が国内法において整備すべき点について検討したものである。本稿では外国仲裁判断の承認及び執行に関する条約(1958年のニューヨーク条約)に規定されている拒否事由を手がかりに、まずその規範内容を条約規定及び関連する国内判例から検討した。ニューヨーク条約における拒否事由は手続面及び実体面の双方に関わるものがあり、特に「国の公の秩序(public order)」については国内法でも用語法や射程が一様ではないことが指摘される。ミャンマーでは近年仲裁法が改正されたが、条約及び関連する各国の国内事例を踏まえて将来的には外国仲裁判断の承認及び執行に関する事案に対処する必要がある。 | |||||
