 note = {In this article, I dealt with a study of child-parent participation in the education system from the view point of the theory of the right. First, I analyzed four theories dealing with the rights of people to education centering on this subject. I hoped to emphasize that in terms of the rights of people to education, a guarantee for a child's right to learn should be centered on and the rights and duties of various parties concerning education should bee stablished. In addition, I wish to consider how the theory of the distinction of "interna and externa" is an important principle in the current education-law system, and to what extent children and parents can participate in school and educational administration; specifically, to what extent a child can participate in the class, parents can participate in the curriculum and extracurricular fields and, more especially, in the field of guidance.},
